PREAMBLE

The site www.mrbricolage-ci.com (hereinafter the "Site") is the property of the Company BERNABE CI, whose registered office is at Treichville Boulevard de Marseille, Km4 registered in the Trade and Credit Register under the name number CI-Abj-1962-B-758. Represented by Mr. Abdul Hussein BEYDOUN, public limited company with a capital of 1,656,000,000. Any reproduction, in whole or in part, is systematically subject to the authorization of BERNABE CI. The Site is operated by the Mr.Bricolage brand, belonging to the company BERNABE CI (hereinafter the “Seller”).

These general conditions of sale (hereinafter the "General Conditions of Sale") govern the contractual relationship between the Seller and its customer-consumer (within the meaning of the preliminary article of law n ° 2014-344) (here- after the “Customer”).

At any time, the Seller may be required to modify some of the provisions of the General Conditions of Sale. These changes will be enforceable against the Customer from the time they are posted on the Site and will be applied to orders subsequent to this posting. Each purchase on the Site is subject to all the clauses of the General Conditions of Sale. The Customer is deemed to have accepted the General Conditions of Sale without reservation when validating his order by ticking the box dedicated to this purpose for the purpose of being able to buy the products on the Site.

The General Conditions of Sale that apply are those valid for consumers.

By validating his order, the Customer declares to have the legal capacity allowing the conclusion of a contract within the meaning of articles 1145 and following of the Civil Code.

1. TERMS OF ORDER

The Seller delivers exclusively in Ivory Coast. Orders are made via the Site.

Any order paid under the conditions provided for in Article 3 of the General Conditions of Sale will result in the receipt of a confirmation email to the email address used by the Customer when opening his account on the Site no later than time of delivery. This email will summarize the elements of the Customer's order and the related information: the name and contact details of the Seller, the delivery costs, the terms of payment, the right of withdrawal, the product ordered, its reference, its price and information relating to the receipt of the product. The sale will not be considered concluded until the confirmation of the order. The information entered by the Customer in his user account of the Site commits him in the event of an error in the wording of the contact details of the recipient of the order. The Seller cannot be held responsible for the impossibility in which it could be to deliver the product ordered by the Customer.

Delivery times will be displayed when the Customer selects the products. It is specified that for deliveries outside greater Abidjan, the delivery time could be modified. The amount of the delivery costs will be indicated in the "My basket" section and is subject to the Customer's approval before validation of the order.

The Customer is informed that the contact number 0811 694 777 (service €0.06 / min + call price) (hereinafter the "Contact number") is made available to him to answer any questions.

For the proper execution of the delivery, the Customer must fill in carefully, at the time of the order, the address of the desired delivery and indicate a telephone number where he can be reached.

The Customer has the option of choosing his delivery method, namely delivery to the “Mr.Bricolage” store or home delivery. The latter may request information on the follow-up of his order by contacting the contact number.

The availability and shipping times will be those of the date of registration of the means of payment.

2. PRODUCTS

The visuals available on the product sheets are not contractual. The color of the products is likely to be altered or different from that appearing on the product sheet, depending on the type of computer installation used by the customer. We cannot be held responsible.

3. PRICE

The prices displayed on the Site are expressed in CFA Francs, all taxes included. The price indicated on the product sheets does not include the price of transport which will be indicated during the validation of the order by the customer.

The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for Côte d'Ivoire.

In the event of a change in the VAT rate, the new VAT rate will be automatically applied without notice other than the date of entry into force of the new rate. The price to be paid by the Customer is the one indicated on the Site at the time of purchase and will be confirmed to the Customer in the order confirmation email. It includes the price of the products and any transport costs. Orders are payable according to the methods described in article 4 of the General Conditions of Sale.

Prices are guaranteed subject to manifest error. In this case, the Seller will cancel the order and inform the Customer by any means.

4. PAYMENT TERMS

Payment for products may be made on the Site by bank card (4.1), by mobile money payment from the operators Orange, MTN and Moov, also by Wave. The Customer will validate his basket and the total price of his order. The sale will then be concluded subject to the subsequent condition of the availability of the product and therefore the sending of a confirmation by email by the Seller. The Seller retains ownership of the goods sold until effective payment of the full price in principal and incidentals.

4.1 Bank card

The Customer may pay for his order by credit card (Visa, MasterCard or CB) with a minimum of 1 euro via a secure banking server of the company ATOS in a secure environment. The Customer's credit card number is sent directly to the bank's servers. The Customer's order will only be considered effective when the bank payment centers concerned have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the Customer notified by e-mail. Furthermore, the Seller reserves the right to refuse any order from a Customer with whom there is a dispute.

4.2 Mobile money

We give our customers the possibility of making their purchases through the Money mobile operators that are Orange Money, MTN Money, Moov Money and Wave. When paying their invoice, customers will be debited for the amount of their merchandise plus a percentage which is directly transferred to the Mobile Money service that has been used. Note that Mr.Bricolage does not receive anything from the rate applied by these financial service providers.

5. AVAILABILITY

The products are available according to the times displayed on the page of the selected product.

In the event that, despite the order confirmation email for a product ordered, the latter were to be unavailable at the time of delivery, the Customer would then be informed by email and may in this case choose to wait restocking, exchanging the ordered product or requesting the cancellation of his order.

The Customer is informed that in certain situations (in the event of limited quantities, sales, end of ranges, etc.) the Seller will not be able to restock even if the product ordered were to be unavailable at the time of delivery. In this case, the Seller will cancel the order and reimburse the Customer.

6. CANCELLATION

The Customer benefits from the possibility of canceling his order after having validated it and this, before the dispatch of the order. The Customer will be reimbursed. To do this, he must send his cancellation request by email to: contact-shop@mr-bricolage.fr or by telephone with the order reference. The cancellation will be taken into account after a processing time of 1 working day. The refund will be made within 14 days of receipt of the Customer's request, by the same means of payment as that made by the Customer. In the case of a delivery in progress, the customer has the possibility of refusing the goods to the carrier. In this case the refund will be made to him reduced by the cost of delivery.

7. WITHDRAWAL

In accordance with the provisions referred to in article L.221-18 of the Consumer Code, the Customer has a right of withdrawal. The legal withdrawal period is 14 days from receipt of the products ordered from the Seller, without the Customer having to justify reasons. If the expiration of the deadline comes to an end on a Saturday, a Sunday or a public holiday, the deadline is extended until the first following working day at midnight. In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the product(s) purchased and the standard shipping costs will be reimbursed; the return costs will remain the responsibility of the Customer.

7.1 - Home delivery:

In the event of withdrawal, the Customer must inform the Seller of his decision to withdraw by sending, before the expiry of the period provided for in Article L.221-18, the withdrawal form or any other declaration expressing the Customer's desire to retract. Upon receipt of the completed withdrawal form, the Customer has 14 days to return the good(s) to the Seller at the address indicated on the return slip. The return form is sent upon receipt of the Customer's decision to exercise his right of withdrawal. The Customer must affix the return form visibly to the package and return this package to the address provided. Any package not identified by the Seller's after-sales service or not received at the address indicated will be systematically refused. When returning, it is recommended that the Customer over-pack the original packaging of the products: only the products returned in their entirety (packaging, cables, accessories, manuals, covers, covers, protections, etc.), with their original packaging will be accepted by the Seller.

All returned products must be intact and in good condition, allowing them to be marketed.

Otherwise, the Seller will be entitled to apply a discount on the returned product. In the event that the product arrives unpackaged and damaged at the after-sales service, the Seller reserves the right to return the product as is to the Customer. Refund or exchange assumes the product was not damaged or returned incomplete. The Customer is free to choose the method of sending his product and whether or not to take out insurance in the event of loss, theft, spoliation or destruction of his package. The Seller does not bear any of the return costs or the cost of transport and cannot be held responsible for the non-receipt of the consumer's package. In general, all the costs and risks associated with the return of the product are the responsibility of the sender. Reimbursement will be deferred until the goods are recovered, or proof of their reshipment is received by the Customer, namely: Copy of the transport voucher mentioning: - the name and address of the sender,

- the name and address of the recipient,

- the date of dispatch,

- the number of the initial order,

- the number of packages,

- the weight,

- the nature of the product.

7.2 Delivery in store Mr.Bricolage

8 - SHIPPING COSTS

The Mr.Bricolage CI store only delivers to Ivory Coast. Once the Customer has selected his delivery address, the basket is automatically updated with the amount of the shipping costs corresponding to the destination and the dimensions of the product that the Customer has entered. The exact amount of his shipping costs will be systematically indicated to him in his basket before he validates his order.

8.1 - Home delivery

Transport costs are detailed below by zone and by package dimensions. Either Small, Medium or Large.

Once the Customer has selected his delivery address, the basket is automatically updated with the amount of the shipping costs corresponding to the destination and the dimensions of the product that the Customer has entered. The exact amount of his shipping costs will be systematically indicated to him in his basket before he validates his order. In the event of absence on the part of the customer when making an appointment with the carrier, the costs of re-delivery will be borne by the customer for a fixed amount of €25. This amount should then be sent by check to the following address: Mr. Bricolage SA "web" - Accounting Department - 1 rue Montaigne 45380 La Chapelle Saint Mesmin, duly completed with the order number on the back of the check and worded on the order from: Mr.Bricolage web. Upon receipt, the carrier will ship the goods to you.

9. Delivery to the “Mr.Bricolage” store

The Customer may have the product, ordered and purchased on the Site, delivered free of charge to the “Mr.Bricolage” store of his choice from among those pre-selected or those appearing in the drop-down list when choosing the store. The contact details of the selected store will be displayed so that the Customer can make an informed choice.

As soon as the Customer's order is available in the Mr.Bricolage store, the Customer receives a text message and an email to the mobile phone number and to the email address that the Customer indicated when taking the order in order to come and collect his order during store opening hours.

The Customer's order is available at the Mr.Bricolage store for a period of 7 working days following the dispatch of the order availability confirmation.

In order to withdraw their order, the Customer must go to the Mr. Bricolage store with an identity document and confirmation of their order. In the event of withdrawal by a third party, the latter must present: an identity document of the Customer, his own identity document, the order confirmation as well as a power of attorney from the Customer authorizing the third party to come and collect the product(s). .

In the absence of withdrawal within this period of 1 month, no refund can take place.

9.1 Home delivery

The Customer may also have it delivered to the address of his choice, namely his home address entered under the “My Account” tab or any other address which he must then complete in the boxes provided for this purpose. Home delivery is chargeable. The amount of the delivery costs will be indicated in the "My basket" section and is subject to the Customer's approval before validation of the order. The type of delivery will be specified in the shipping email. It is specified that the delivery will be made at the property limit. In the event that the carrier does not allow the Customer the possibility of checking the condition of the goods delivered, for any reason whatsoever, the Customer must imperatively mention this on the transport slip and have it countersigned by the carrier.

10- RETURN A PRODUCT

Terms of the return policy: The Customer has a period of 7 days to return an item to the Seller.

The item must be returned in its original packaging, accompanied by all the accessories and manuals, be in good condition, and accompanied by their invoice. Custom-made products will not be taken back.

Return in store for 2-hour orders (made in the store with a salesperson): The Customer can return any item in good condition to their original Mr.Bricolage store free of charge, for a product withdrawn 2 hours and orders in countermark. Stores only take back items in perfect condition (this means commercially resalable).

Return by carrier: To return an item by the services of a carrier to the Seller, the Customer is invited to contact customer service in order to organize the return. Within 72 hours after delivery (with or without reservations), if the Customer's item was delivered broken or defective, the Seller will ask to provide photos of the damage to customer service. A return label will then be given to the Customer. It must be stuck in a visible manner on the packaging of the product. If it is a small package, the Customer can then entrust his package to La Poste, and use the shipping number of the package to track the return. In the case of a heavy and bulky item, the Customer will be contacted within three (3) working days to arrange an appointment with the carrier in charge of collecting the package. An email will then be sent to the Customer to confirm receipt of the returned item by the Seller's services. You will be asked to pack / over-pack the product in accordance with the shipment of your initial order (on a pallet, filmed and secured for return transport). The Seller will only take back products returned in their entirety (packaging, cables, accessories, manuals, covers, covers, protections, etc.), with their original packaging, all of which must be intact and in good condition allowing their marketing. If the product returned by the Customer arrives unpackaged and damaged at our warehouses, the Seller will apply a discount to the returned product.

Refund terms Refunds are issued upon receipt of the item by the Seller's services or following collection by the Seller's carriers within the limit of 14 legal days.

The refund is made on the payment method chosen for the order, the return costs remain the responsibility of the Customer.

11 – DISPUTES – MEDIATION

These general conditions of sale are subject to Ivorian law. In the event of difficulties in the application of these general terms and conditions of sale, the Customer has the option, before any legal action, of seeking an amicable solution, in particular with the help of: a professional association in the sector, a consumer association or any other counsel of its choice. It is recalled that the search for an amicable solution does not interrupt the duration of the legal guarantee, nor the duration of the contractual guarantee. The claimant may seize, at his option, in addition to the jurisdiction of the place where the defendant lives, the jurisdiction of the place of actual delivery of the thing or the place of performance of the service.

In the event of an unresolved complaint despite a written request, the Customer may request consumer mediation by contacting the structures dedicated to this purpose.

12 - PERSONAL DATA

The information of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, as well as the establishment of invoices. The lack of information leads to the non-validation of the order. In accordance with the law "Informatique et Libertés", the processing of personal information relating to the Customer has been declared to the National Commission for Informatics and Liberties (CNIL). The Customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with the Seller.

By accepting these General Terms and Conditions of Sale, the Customer acknowledges having been informed that his Personal Data may be transmitted to third parties for the purpose of collecting his opinion following his order.
